Limitation of liability
Neither party will hold the other party liable for its indirect losses arising under or in connection with the Agreement.
Except in case of gross negligence by a party, the total maximum liability of that party towards the other party arising out of or in relation to the Agreement, shall be limited to the greater of (i) a maximum aggregate sum equal to five percent (5%) of all compensation paid by both parties to the other party under the Agreement in the six (6) months preceding the Claim; or (ii) NOK 250,000 (whichever is higher). For claims arising before 6 months have passed, the limitation shall be equal to an extrapolation to 6 months based on the payment incurred at the time of the Claim.
In no event shall either Party be held liable to the other Party for any fraudulent or otherwise criminal acts committed by an Authorized User through the Payment Solution.
In no event shall ZTL be held liable for losses incurred as a result of circumstances encompassed by Clause "​​​Delivery of an 'as-is' and 'as-available' service" (Support & Maintenance).
The indemnities set out in clause 13 are not subject to the limitation of liability.
